These Terms of Service (Terms) apply to your use of the Leonidas Grove website and store, and to any order you place with us. In these Terms, we, us and our means Leonidas Grove Pty Ltd. By using our website or placing an order, you agree to these Terms. Please read them together with our Privacy Policy, Shipping Policy and Refund Policy, which are available on this website.
1. Our store
Our online store is hosted by Shopify, which provides the platform that lets us sell to you. Any purchase you make is a sale directly between you and Leonidas Grove Pty Ltd.
2. Eligibility
To place an order you must be at least 18 years of age and provide accurate, current and complete information. You are responsible for keeping any account details secure.
3. Products
We do our best to describe and show our products accurately. Colours and appearance may vary depending on your screen. As a natural product, each harvest varies, and flavour and characteristics may differ slightly from batch to batch. We may change or discontinue products at any time.
4. Orders
When you place an order you are making an offer to buy. We may accept or decline any order at our discretion, and your order is confirmed once we send you an order confirmation. If we cannot fulfil an order, we will contact you and arrange a refund.
5. Prices and payment
Prices are in Australian dollars and include GST where applicable. Prices, discounts and promotions may change at any time, but the price that applies to your order is the price shown at checkout when you place it. Payment must be received before we dispatch your order.
6. Shipping and delivery
We ship within Australia only. Shipping costs, dispatch times and delivery estimates are set out in our Shipping Policy. Delivery estimates are not guaranteed.
7. Returns and refunds
All sales are final except where a product is faulty or not as described. Your rights are set out in our Refund Policy and are protected by the Australian Consumer Law.
8. Australian Consumer Law
Our products come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms limits or excludes any right or remedy you have under that law. Where we are permitted to limit our liability, we do so as set out below.
9. Acceptable use
You agree to use our website lawfully, and not to misuse it, interfere with its operation, attempt to gain unauthorised access, or use it to infringe the rights of others.
10. Intellectual property
Our website content, including text, images, logos and the Leonidas Grove name and branding, is owned by us or our licensors and is protected by law. You may not copy, reproduce or use it for commercial purposes without our written permission.
11. Third-party links
Our website may link to third-party websites. We are not responsible for the content or practices of those websites, and access is at your own risk.
12. Relationship with Shopify
Leonidas Grove is powered by Shopify, which enables us to provide our store to you. Any sale is made directly with Leonidas Grove Pty Ltd. Shopify is not responsible for any aspect of the sale between you and us, including any loss or damage arising from the products, and you release Shopify and its affiliates from any claims arising from your purchases and transactions with us.
13. Limitation of liability
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law. Subject to that law, and to the extent permitted by law, we are not liable for any indirect or consequential loss, and our total liability to you is limited to the amount you paid for the relevant order.
14. Privacy
We handle your personal information in accordance with our Privacy Policy, available on this website.
15. Governing law
These Terms are governed by the laws of New South Wales, Australia. You and Leonidas Grove Pty Ltd submit to the non-exclusive jurisdiction of the courts of New South Wales.
16. Changes to these Terms
We may update these Terms from time to time. The current version will always be available on this page, and your continued use of our website means you accept the updated Terms.
